Who needs estate planning and why do they need it?

Estate plans are not just for the wealthy—everyone needs an estate plan. A properly prepared estate plan protects and provides for your family upon your passing, transferring your assets according to your wishes in as seamless a way possible. If you have children under the age of eighteen, an estate plan is important to designate a guardian for your child or children in the event of your passing. It also creates ways for your executor or power of attorney to provide for your care in the event you are not able to make decisions for yourself.

Is a will or a trust right for me?

What estate plan is right for you depends on many factors that the attorneys at Lee & McInerney will be happy to discuss with you. In many ways, a will is the most simple form of an estate plan. A will provides for your desires regarding what happens with your assets upon your passing. However, a will still goes through the probate process. A trust agreement avoids the probate process, so long as the trust is properly funded. We are happy to discuss whether a will or trust is right for you, and what type of trust is right for you.

What makes up a good estate plan?

What makes up an effective and appropriate estate plan greatly depends on your assets and your wishes for how your assets are administered during your life and upon your passing. An effective estate plan will contain documents that allow your power of attorney to access your assets and make decisions on your behalf while you are alive, should it become appropriate. Your estate plan should also contain documents with appropriate provisions to distribute your assets in a way that honors your wishes and protects what you have built.

Are there special concerns for the LGBTQ+ community in developing an estate plan?

There are several special considerations for the LGBTQ+ community when preparing an estate plan. Marriage equality under the law created new possibilities in estate planning for married couples. However, the LGBTQ+ community faces many challenges and pitfalls in preparing an estate plan, whether married or not. The attorneys at Lee & McInerney can help you develop an estate plan that fits your unique situation, and protects your life and end of life wishes.

Are there special concerns for the immigrant community in developing an estate plan?

Immigration status can drastically impact how an estate plan is prepared, particularly if you own property in the United States. It is critical for non-US citizens to consult with an experienced estate planning attorney. The attorneys at Lee & McInerney can help guide you through the various issues of estate planning that are complicated by immigration status.

What are the steps to develop my estate plan, and how long will it take?

How long it takes to develop your estate plan initially depends on how quickly you provide your financial, asset, and debt information, along with information concerning how you would like your assets to be distributed or managed. Once we have the information, we will provide a draft of your estate plan within two weeks. At that point, we will review the plan with you, make any needed changes, and finalize the plan for your signature. Once your estate plan is ready to sign, we will arrange a signing appointment to ensure that your estate plan is correctly executed.

Does my business need an operating agreement or by-laws?

It is common for someone to form a business under New York law, but to take no additional steps, such as creating business operating documents, insurance, or separate bank accounts. The failure to take such steps could leave you open to personal liability for debts or lawsuits. The attorneys at Lee & McInerney can help you prepare documents to make your business run more smoothly and protect your personal assets from business debts.

Does my business need a succession plan?

Business owners should create a plan for what happens to a business in the event of your retirement, death, or other business transition. The attorneys at Lee & McInerney can help you determine an appropriate plan to manage and wind-up your business, including managing business assets, upon your retirement or passing.

Is mediation right for me?

Mediation is an alternative dispute resolution mechanism that allows participants to settle their disputes with little or no court intervention. If you seek to resolve your dispute or case as amicably as possible, mediation may be appropriate for you. The attorneys at Lee & McInerney can advise you regarding whether mediation is right for you and what the mediation process entails.

What types of cases are right for mediation?

Mediation is right for many different types of cases, including business disputes, divorce and custody matters, and many other types of civil matters. Mediation may also be helpful in resolving estate planning disputes and to develop plans of care for elderly individuals or family members in need. The attorneys at Lee & McInerney can help you determine whether mediation or another form of alternative disputes resolution is right for you and your case.
